A man was understandably furious and upset when he woke up to discover that the person performing oral sex on him was not his girlfriend, but a male stranger.
As reported by the Mail Online, the victim was sexually assaulted by Dale Everard after he’d fallen asleep on his bed fully clothed after a night out with his girlfriend in Dunfermline, Fife.
The court heard how the victim, believing it was his girlfriend performing the sex act, allowed it to continue for a short while before he opened his eyes and saw the unpleasant truth.
The victim then reportedly leapt out of the bed “in a state of shock and anger” and burst into tears after Everard told him “you liked it”. He then pushed Everard out onto the street.
The victim and his girlfriend had met Everard earlier that evening at a nightclub, after the 22-year-old had been on a failed first date.
The male opted to head home early because he had a headache, but his girlfriend and Everard stayed out and bonded over some drinks.
When they returned home later that night, a little worse for wear, they woke the sleeping man. The couple then had an argument and fell out because she’d brought a stranger back to stay at their house.
She fell asleep on the sofa, while he slept on the bed in their room, which is where the sexual assault took place later that night.
First time offender Everard was jailed for 18 months on Monday after he admitted to assaulting the man while he was asleep, under the influence of alcohol and incapable of giving or withholding consent.
He has also been put on the sex offenders register, with Sheriff Craig McSherry adding: “This was a serious offence carried out with considerable forethought. You befriended the victim’s girlfriend, went back to the flat with her, entered the bedroom and carried out the sexual assault.”
