A woman claims she had a job offer withdrawn after her bosses discovered a racy photograph on her Instagram page.

Samantha Chirichella was due to start a £47,000-a-year job as a staff investigator in the legal services department of energy firm ConEd, before bosses found the photo during a background check, The Mirror reports.

The image, which was taken three years ago, shows two women lying naked next to each other, with one kissing the others’ nipple.

Samantha, from New York, said in papers filed in Manhattan Supreme Court that the picture is art – not porn – and it was shown in a gallery art show which featured her friend’s photography.

Her lawyer, Arthur Schwartz, said in court papers:

What stood out to us most vividly about the Instagram page is not the Con Edison evaluator’s poor sense of artistic judgment, but the context.

The work was no more sexually explicit that the works of DaVinci, Titian or Michaelangelo, and less explicit that photos published in Sports Illustrated.

He does have a point.

The suit, filed by Samantha, alleges that the company discriminated against her for her sexual orientation because, in the comment section of the post, a friend had asked if she was a lesbian, and Samantha responded back that she was, according to The Mirror.

The 26-year-old’s lawyer said ConEd was actually offended by the discussion about Chirichella’s sexual orientation – not the image – and discriminated against her based on the fact that she may be a lesbian.

If this is true, it’s very worrying that this sort of discrimination still exists.
