A student is suing his drama school after he claims he was suspended for having a “consensual threesome” with a woman who he says later changed her mind.

The student claims he engaged in a threesome with a female student and another male friend, but that the woman later changed her tune about the two men’s behaviour.

Both men were suspended after the woman complained to the college, and it was determined that the two men had violated the school’s sexual misconduct policy. New York City drama school also forced the men to attend sex-violence training because of their antics.

The three plaintiffs involved in the case are referred to as John, Jane and Richard Doe, according to the New York Post. John reportedly met Jane during his freshman year and he claims it was she who initiated the ménage à trois and even helped him find the other man to join them in bed.

However, afterwards she expressed regret about the threesome and, in a recording, she reportedly said: “It was just a lot to handle… Both of you guys at one time.”

The audio clip also appears to reveal that the girl was open to future hook-ups with the two men, just not at the same time: “I mean, damn. Maybe another time, but at different times.”

After John appealed the school’s decision to suspend him, the drama school dropped the charges of violating its sexual misconduct policy and instead slapped him with new charges of violating “basic rules of conduct”.

John has since taken his school to court for acting in breach of Title IX that “prohibits discrimination on the basis of sex in any federally funded education program or activity”, according to the U.S. Department of Justice.
