A nine-year-old boy from San Jose, California, is being treated in hospital after he was hit by a bullet fired from the apartment above his bed.
The boy was sleeping when at 5:45am a neighbour upstairs discharged a round from a high powered assault rifle, hitting himself in the foot before penetrating the floor and hitting the child.
Eric Smith has been identified by police as the gunman responsible and has been placed in Santa Clara County Jail for negligent discharge of a firearm.
Police are investigating whether or not the rifle was legally owned, and if the incident truly was a bizarre accident.
A friend of the family revealed the boy’s mother was awoken by the sound of her youngest of three children wailing in agony.
A stunned neighbour has been quoted as saying:
This is amazing. I can’t believe it happened. It’s really hard. I have kids, too,”
Both man and boy sustained ‘serious’ injuries, but neither are believed to be in a life-threatening condition.
